Q   My contract has an arbitration clause requiring that disputes must go to arbitration.        Will my case go to arbitration? A  No.  Our legal team has advised us that, in their opinion, the arbitration stipulation in all VIPKID contracts is illegal and will not be recognized by the court.  Our legal team has advised us that the purpose of the arbitration clause is to hide these VIPKID contracts from the court.  They make their fear of the court system obvious in the language of the contracts. This is a criminal offense known as Perverting the Course of Public Justice.  The law provides for fines and up to 7 years imprisonment as penalties for this crime.  The courts of Hong Kong do not tolerate the crime of Perverting the Course of Public Justice.  Recently, a prominent, corporate CEO was arrested, convicted, and sent to prison for his crimes, (Hong Kong v. Lew Mon- hung.)  In another case, a Hong Kong lawyer received a prison sentence for his crimes (Hong Kong v. Yeung Wai Birney.) Our legal team has assured us that the VIPKID directors and attorneys will be held accountable for their actions as well.  This is the opinion of our legal team.  Any final determination of illegality can only be affirmed by a court of law.      The following language from the current VIPKID contract clearly displays their fear of the courts and the justice system. d) Waiver of Right to Court or Jury Trial.  Consultant understands that by signing this Arbitration Agreement, both the Company and Consultant are giving up any right they may have to a court or jury trial on all claims Consultant and the Company may have against each other. Q  My contract was terminated by VIPKID.  Am I entitled to compensation for being terminated? Yes.  Our legal team has advised us that, in their opinion, the laws of Hong Kong award the, “full potential value,” of the contract as compensation for your losses.  The full potential value of your contract is the maximum amount of money that you could have potentially earned if VIPKID did not terminate your contract. I am currently teaching for VIPKID and would like to join the union.  Will VIPKID terminate my contract? A  Yes. Our legal team has advised us that, in their opinion, it is illegal for a company to terminate a worker for union activity; however, VIPKID has demonstrated a flagrant disregard for the law.  This is why we keep all of your information confidential as we fully expect VIPKID to violate the law at every opportunity that they have to do so. This is the opinion of our legal team.  Any final determination of illegality can only be affirmed by a court of law. I have been paying self-employment tax in the USA.  What happens when the court rules that I was an employee? A  Our legal team has advised us that, in their opinion, VIPKID contracts function to allow VIPKID to illegally evade taxation.  Our legal team has further advised us that that the tax authorities of USA and Canada will be kept apprised of the legal proceedings and may become involved in the case.  The final result of a court judgment will determine exactly what the tax liabilities are in this case. Our legal team has advised us that the answers to your question will be determined when the case has been finished, settled and fully resolved. Q  I am currently teaching at VIPKID.  How is the current contract considered to be illegal? A  Our legal team has advised us that, in their opinion, all VIPKID contracts violate labor law, resulting in the victimization of teachers by failing to provide employee benefits.  These contracts also allow VIPKID to evade taxation.  The language of the new contract compels teachers to surrender all of their rights to a court or a jury trial.  Our legal team has advised us that, in their opinion, this contractual language is used to hide that contract from the courts. It appears as though VIPKID legal council intentionally chose this language to hide their contract, labor practices, and evasion of taxation from the courts.  Creating a contract with terms that are intended to hide the contract from the courts is a criminal act in Hong Kong. This is the opinion of our legal team.  Any final determination of illegality can only be affirmed by a court of law. Q  I have joined the union and submitted all of my documents to qualify for the legal action.       How long will this take to have everything resolved with VIPKID? A   We don’t know.  We are open to a quick settlement. We are also willing and able to continue this for several years.  We have a well-funded organization. We are capable of sustaining a long legal battle. Why is the union not on Facebook? A   Our bylaws require that the identities of our membership be kept strictly confidential.  Facebook makes the names of the members of groups available for anyone to see.  Facebook does not offer the identity security that we require.  Even without being on Facebook, most of our website traffic comes from Facebook and a large number of our union members joined our union by following a link from Facebook.  On December 18th someone posted a link on Facebook that resulted in 3,575 new visitors to this website. Our membership committee is still buried in hundreds of membership applications from that day.  We are not on Facebook but plenty of you are, so thanks for sharing the link. If you can clarify the site's claims; please do.”                                                                                                                                                                - Chophouse - 2017-12-28 There has never been a statement on this website that VIPKID, “moved to Hong Kong.” VIPKID is legally known as, VIPKID Hong Kong Limited, Hong Kong corporate registry number 2117782. If you are a VIPKID teacher, please look at the signature stamp on your contract. If the signature stamp reads, VIPKID HK Ltd., then you are under contract with VIPKID, a Hong Kong corporation. Does this resemble the signature stamp on your contract?                                                                                                                  Hong Kong Corporate Registry report.  Confirm this as fact at this link  https://www.cr.gov.hk/ VIPKIDS INTERNATIONAL INC., recently registered as a Delaware, USA corporation. The current teacher contract states that the contract is under the laws of Delaware, USA.  Our legal team disagrees with that because if a contract is with VIPKID HK Ltd., a Hong Kong corporation, then that contract is under the laws of Hong Kong. No, VIPKID did not move to Delaware. They opened a dummy office there to take advantage of the notoriously pro-business and anti-worker laws of Delaware.  Does your contract state that you are under contract with VIPKIDS INTERNATIONAL INC? VIPKID opens dummy offices wherever they can exploit the law.  They have a dummy office in Hong Kong to exploit the tax laws and they have a dummy office in Delaware to take advantage of the anti-worker laws. Thank you for your post to the  eslteachersboard.com   -  Avoid VIPKIDS message thread.                                                                                                                   We are sorry that our statements that VIPKID is a Hong Kong corporation was interpreted by some to mean that,”VIPKID moved to Hong Kong.”  Yes, VIPKID has a dummy office in Hong Kong but they did not move their main operations to Hong Kong.  Thank you for alerting us to this. We have edited the Legal Action page to clearly explain that VIPKID is a Hong Kong corporation.  All information on this website is true and correct - to the best of our abilities and according to the opinions of our legal team.
